The Family-Based Immigration Process

The process to bring your loved ones to the U.S. involves a few key steps:

  1. Filing a Petition: As a U.S. citizen or permanent resident, you'll begin by filing Form I-130, Petition for Alien Relative, with USCIS to start the process.

  2. Petition Approval & Visa Availability: Once USCIS approves the petition, it goes to the National Visa Center (NVC). If you’re in the family preference category, your loved one will have to wait until their visa becomes available due to annual limits.

  3. Consular Processing or Adjustment of Status:

    • Consular Processing: If your family member is outside the U.S., they’ll apply for an immigrant visa at a U.S. consulate in their country.
    • Adjustment of Status: If they’re already in the U.S., they may be able to adjust their status to permanent resident without leaving the country.
  4. Medical Exam & Interview: Your family member will need to get a medical exam and attend an interview with a USCIS or consular officer to ensure they meet all eligibility requirements.

  5. Approval & Entry: Once approved, they’ll receive their visa or green card, allowing them to legally enter and stay in the U.S.
